The following Terms of Use are entered into by and between you (the “Student”) and Kayla Trautwein (the “School Owner/Coach”).

The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of School Owner's Websites, including, without limitation, kaylatrautwein.com, and kayla-trautwein.teachable.com (the “Websites”), including any content, Facebook fan pages, Facebook group pages, functionality and services offered on or through Websites), whether as a guest or a registered user.



1. Terms

By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.



2. Use License and Proprietary Nature of Materials

School Owner's program is copyrighted and original materials that have been provided to Student are for Student's individual use only and a single-user license. Student is not authorized to use any of School Owner's intellectual property for Student's business purposes. All intellectual property, including School Owner's copyrighted program and/or course materials, shall remain the sole property of School Owner. Student acknowledges that the School Owner may use and modify existing materials for Student's benefit and that Student holds no rights to such materials. No license to sell or distribute School Owner's materials is granted or implied.


By purchasing this program, you agree (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by the School Owner is confidential and proprietary, and belongs solely and exclusively to the School Owner, (3) You agree not to disclose such information to any other person or use it in any manner other than in discussion with the School Owner. Further, by purchasing this product, Student agrees that if you violate, or display any likelihood of violating, any of School Owner's agreements contained in this paragraph, the School Owner will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.


Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on the School’s web site;
  4. remove any copyright or other proprietary notations from the materials; or
  5. transfer the materials to another person or 'mirror' the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by School Owner at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.



3. Disclaimer

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

The Student is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Student agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Student understands that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

The Student acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Student agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Student's responsibility.

Student acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Student's exclusive responsibility to seek such independent professional guidance as needed.

The Student acknowledges that he/she is in good physical and mental health and are not under any type of care that would prevent you from fully participating through the duration of the program. This program evokes honest, self-examination, which takes place in a safe and thought-provoking environment where intense, transformational experiences are not uncommon. By participating, you are acknowledging that you are prepared to have such an experience.



4. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.




5. Revisions and Errata

The materials appearing on the School’s websites may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.



6. Links

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.



7. Site Terms of Use Modifications

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.



8. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.



9. Fees and Payment

As consideration for any purchase you make on the Websites, you shall pay School Owner all applicable fees and taxes. School Owner (or our third-party payment processor) shall authorize your credit card, bank account, or other approved payment facility you provided during the registration process for the full payment of the fees and any applicable taxes, and you hereby consent to the same. If you enrolled under a payment plan, you are responsible for all monthly payments.


You must provide current, complete, and accurate billing and credit card information. You must promptly update all billing information (such as billing address, card number, and expiration date) to keep your account current, complete, and accurate, and you must promptly contact us if your credit card is lost or stolen, or if you become aware of a potential breach of account security (such as an unauthorized disclosure or use of your Sign-In Name or Password). You hereby authorize School Owner to obtain or determine updated or replacement expiration dates for your credit card in the event that the credit card you provided us expires. School Owner reserves the right to charge any renewal card issued to you to the same extent as the expired card. If payment is not received from your credit card issuer, you hereby agree to pay all amounts due upon demand. You agree to pay all costs of collection, including attorney’s fees and costs, on any outstanding balance. In certain instances, the issuer of your credit card may charge you a foreign transaction fee or related charges, which you will be responsible to pay. You are advised to check with your bank and credit card issuer for details.



10. Limited Liability and No Guarantee


Except as expressly provided in this Agreement, the School Owner makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. Examples of results obtained for other clients of the School Owner may be used as a marketing tool and shown to Student for demonstrative purposes only and should not be construed by Student as indicating any promised results or level of results. 

Student accepts and agrees that Student is 100% responsible for Student's progress and results from the services. Student accepts and agrees that Student is the one vital element to success and that School Owner cannot control Student. School Owner makes no guarantee or warranty that the program will meet the Student's requirements or that all Students will achieve the same results. 

In no event shall the School Owner be liable to the Student for any indirect, consequential or special damages. Notwithstanding any damages that the Student may incur, the School Owner's entire liability under this Agreement, and the Student's exclusive remedy shall be limited to the amount actually paid by the Student to the School Owner under this Agreement for all coaching services rendered through and including the termination date.



11. Confidentiality


The Websites provide Registered Users the ability to post and upload Registered User Content (collectively "Submissions"). You expressly acknowledge and agree that once you submit your Registered User Content for inclusion into the Websites, it will be accessible by others, and that there is no confidentiality or privacy with respect to such Registered User Content, including, without limitation, any personally identifying information that you may make available. You are entirely responsible for all of your registered user content that you upload, post, email, or otherwise transmit via the Websites.


This coaching relationship, as well as all information (documented or verbal) that the Student shares with the Coach as part of this relationship, will be kept in confidentiality. However, please be aware that the Coach-Student relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. 


The Coach agrees not to disclose any personally-identifiable information pertaining to the Student without the Student's written consent. The Coach will not disclose the Student's name as a reference without the Student's consent. Student acknowledges that his/her results may be anonymized for promotional purposes.



12. About the use of Hypnotherapy Techniques


Coach has created self-hypnosis audio recordings that reinforce the program content in order to help Student experience rapid results in 8-weeks. Self-hypnosis audio recordings are similar to guided meditations. They use relaxation techniques, visualizations, and positive affirmations to help Student experience positive changes in his/her thoughts, feelings, and habits. Coach also offers occasional live group Hypnotherapy sessions to achieve the same goals.


The following acknowledgement is typically only required in a 1:1 Coach/Client Hypnotherapy setting. California Law requires the disclosure that Hypnotherapy is not a practice of medicine, as Hypnotherapist is not a licensed physician. Methods used are non-diagnostic, and are complementary to the healing arts services that are licensed by the state. The California State Legislature has determined that state licensing may not be conferred upon an occupational group for purposes of status or prestige. The primary purpose of licensing laws for legally defined Healing Arts and Mental Health professionals is to protect public health and safety. Accordingly, Hypnotherapists are not issued licenses by any state governmental agency to engage in their professional services.


Coach has received a certification in Hypnotherapy from the accredited training program, The Center for Advanced Life Skills Therapy in Los Angeles, CA. 



13. 14-Day Money Back Guarantee


It is Coach's hope that, should Student decide to enroll in any of Coach's programs, that he/she is highly motivated and willing to put in the daily effort necessary to reap the results. However, Coach wants Student to feel confident in his/her purchase. Therefore, the School offers a full 14-day money back guarantee. Student may try the program risk-free and if he/she is not satisfied with it, ask for a refund within 14-days and be refunded in full.


Student must request his/her money back within 14-days of the purchase. The student may request his/her money back by emailing [email protected]. Student's email must contain information about the course he/she purchased, the date of the purchase, and the email and name associated with any such purchase. Under no circumstances will refunds be provided after 14-days from the purchase date.


Once Student receives a refund, he/she will immediately lose access to all course materials including any bonus courses derived from his/her purchase.



14. Severability


If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
